Welcome to Jackpot Ascend! These Terms of Service (“Terms”) govern your use of the Jackpot Ascend mobile application (the “App”) operated by Mighty Handful Games (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Social Casino — No Real Money Gambling

Jackpot Ascend is a social casino game designed purely for entertainment.

  • The App does not offer real-money gambling of any kind.
  • All coins, chips, tokens, and other in-game currency (“Virtual Currency”) are virtual items with no real-world monetary value.
  • Virtual Currency cannot be exchanged, transferred, or redeemed for real money, real goods, or any other items of monetary value.
  • Success in social casino games does not imply future success at real-money gambling.
  • No actual money can be won or lost while playing Jackpot Ascend.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the App. By using the App, you represent and warrant that you meet this age requirement. We reserve the right to request proof of age and to terminate accounts that violate this requirement.

3. Account and Virtual Currency

3.1 Account

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3.2 Virtual Currency and Virtual Items

  • Virtual Currency and virtual items are licensed to you, not sold. You do not own them.
  • We may modify, manage, regulate, or eliminate Virtual Currency and virtual items at any time, with or without notice.
  • We are not liable for any loss of Virtual Currency or virtual items due to technical issues, account termination, or changes to the App.
  • Virtual Currency has no cash value and is non-refundable except as required by applicable law.

4. In-App Purchases

  • The App offers optional in-app purchases of Virtual Currency and other virtual items through Google Play.
  • All purchases are final and non-refundable, except as required by applicable consumer protection laws (including EU consumer rights).
  • Prices are displayed in your local currency and may include applicable taxes.
  • You agree that all billing and transaction processes are handled by Google Play, and any payment disputes should first be directed to Google Play support.
  • If you are in the European Union, you have the right to withdraw from a digital content purchase within 14 days, unless you have given express consent to begin performance and acknowledged the loss of the right of withdrawal.

5. User Conduct

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Attempt to exploit, hack, reverse-engineer, or modify the App
  • Use automated scripts, bots, or cheating tools
  • Engage in any activity that disrupts the App or its servers
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Buy, sell, or trade accounts or Virtual Currency outside the App
  • Engage in data mining, scraping, or unauthorized data collection

6. Intellectual Property

All content in the App — including but not limited to graphics, designs, text, sounds, music, animations, game mechanics, and software — is the property of Mighty Handful Games or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content in the App without our express written consent.

7. Advertising

The App may display third-party advertisements. We are not responsible for the content, accuracy, or practices of any third-party advertisers. Your interactions with advertisers are solely between you and the advertiser.

8. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Mighty Handful Games and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the App.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law. In no event shall our total liability exceed the amount you have paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mighty Handful Games from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately, and any Virtual Currency or virtual items in your account will be forfeited.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the App.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Belgium. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Belgium.

If you are a consumer in the European Union, you also retain the benefit of any mandatory provisions of the law of your country of residence. You may also use the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
